TERMS AND CONDITIONS

Please read all these terms and conditions.

As we can accept your bookings and make a legally enforceable agreement without further reference to you, you must read these terms and conditions to make sure that they contain all that you want and nothing that you are not happy with. Application

  1. These Terms and Conditions will apply to the purchase of the services by you (the Customer or you). We are Motolani Sunmola trading as MOVIV of 1 Sumner Court, Darsley Drive, City of London, SW8 2BA with email address; [email protected] telephone number; 02074982592 (the Supplier or us or we).
  2. These are the terms on which we sell all Services to you. Before placing bookings on the Website, you will be
    asked to agree to these Terms and Conditions by clicking on the button marked ‘I Accept’. If you do not click on
    the button, you will not be able to complete your booking. You can only purchase the Services from the Website
    if you are eligible to enter into a contract and are at least 18 years old.

Interpretation

3. Consumer means an individual acting for purposes which are wholly or mainly outside his or her trade, business, craft or profession;
4. Contract means the legally-binding agreement between you and us for the supply of the Services;
5. The Event means any holiday, accommodation, activity of function organized or advertised by us.
6. Price means the total cost of event.
7. Supplier means the company or person that is holding or providing the event or any part of it.
8. Booking means the Customer’s booking for the Services from the Supplier as submitted following the step by step process set out on the Website;
9. Privacy Policy means the terms which set out how we will deal with confidential and personal information received from you via the Website;
10. Services mean the services provided by movivtravel.co.uk advertised on the Website, of the number and description set out in the booking;
11. Website means our website movivtravel.co.uk on which the Services are advertised.

Personal information and Registration

12.When registering to use the Website, you must set up a username and password. You remain responsible for all actions taken under the chosen username and password and undertake not to disclose your username and password to anyone else and keep them secret.
13.We retain and use all information strictly under the Privacy Policy.
14. We may contact you by using e-mail or other electronic communication methods and by pre-paid post and you expressly agree to this.
15. Any quotation or estimate of Fees (as defined below) is valid for a maximum period of 14 days from its date, unless we expressly withdraw it at an earlier time.
16. No variation of the Contract, whether about description of the Services, Fees or otherwise, can be made after it has been entered into unless the variation is agreed by the Customer and the Supplier in writing.

Services and Contract

17. The description of the Services is as set out in the Website, catalogues, brochures or other form of advertisement. Any description is for illustrative purposes only and there may be small discrepancies in the size and colour of any booking.
18. All Services which appear on the Website are subject to availability.
19. Written confirmation will be sent to you by email only when we receive full deposit. Until we receive the deposit required to be paid, no contract will be formed between you and us.

Customer Obligation

20. In the case of Services made to your special requirements, it is your responsibility to ensure that any information or specification you provide is accurate. You have (to) at all times comply with age restriction imposed by all our suppliers.
21. It is your responsibility to travel with correct passport, valid visa and appropriate vaccination before your travel. You must take out suitable insurance for unforeseen event such as delay for event that involves travel by air, land and sea.
22. You are responsible for your behavior and that of your group if in breach of these obligations, we may cancel or impose a restriction on the event or part of it. You shall comply with event‘s arrival time and dress code.

Our Obligation

23. We will supply the Services with reasonable skill and care in arranging the event and shall comply with all applicable laws in relation to the event.

MovivTravel is a company committed to customer satisfaction and consumer financial protection. We are therefore pleased to announce that, at no extra cost to you, and in accordance with ”The Package Travel, Package Tours Regulations” all passengers booking with MovivTravel are fully protected for the initial deposit, and subsequently the balance of monies paid as detailed in your booking confirmation form. Your money is fully protected and paid into an independent Trust Account, managed by Protected Trust Services Ltd of 307-315 Holdenhurst Rd, Boscombe, Bournemouth BH8 8BX and its Trustees, chartered accountants – Elman Wall Ltd of 8th Floor, Becket House, 36 Old Jewry, London EC2R 8DD.

Payment and Deposit

24. You must pay by submitting your credit or debit card details with your booking and we can take payment immediately or otherwise before delivery of the Services.
25. Deposit must be at the initial stage of booking and payment of balance is split into the following: An agreed non-transferable and non-refundable deposit that is payable at the time of booking. The final balance is to be paid not less than 28 days before the date your event is to commence. Failure to pay by this date will result to a £10 per person for late payment charge. If you do not make your payment by this due date given, then you shall be considered to have cancelled the event. Deposit is used to enter contractual arrangement on your behalf and is not refundable.

Changes to Price

26. We will seek to place the booking for you at the same price. We can change your event price after you booked it but only in certain circumstances.
27. Any reasonable changes you wish to make will be accommodated. Alteration and amendment request should be made with us and not end suppliers and be made in writing by the lead name. This change shall be considered accepted until we have confirmed in writing to you. If you wish to increase or decrease the number of people participating in the event, you shall do these six weeks in advance upon the date which your event is due. Amendment after that date will be subject to our administrative charges per person. We cannot guarantee that the change to the price will be proportional, but depends on arrangement we are able to make with your supplier. You may transfer the booking to another person who satisfies all the conditions applicable to the event, however subject to our written agreement.
28. Considering the case of circumstances beyond our control it will become necessary to substitute an alternative supplier, or make alteration to the event this could include accommodation. We shall inform you of the changes as soon as possible. You must pay any additional cost due to the changes. If you are unwilling to accept these changes, then you can cancel the event and we will give a refund of the cost of the event

Meals and Accommodation

29. Otherwise stated, breakfast is not included with accommodation. The type of breakfast you will receive will be confirmed upon your arrival at your accommodation. Hotel or restaurant may require pre-book to be completed by the lead name of your group. This should be returned to us or the venue as required. If a pre-book has not been completed, we will not accept any liability for meals not provided or delayed for
you.
30. If your booking includes accommodation, the name accommodation will be confidential to your company name and can only be disclosed to you upon receipt of the completed additional deposit and written confirmation from your supplier

Right to cancel

31. Subject as stated in these Terms and Conditions, you can cancel this contract within 14 days after the initial deposit but must be advised that this deposit is non-refundable. After 14 days you may cancel your booking though, all deposit and any additional payment that is up to date on the booking are nonrefundable To exercise the right to cancel, you must inform us of your decision to cancel this Contract by a clear statement setting out your decision from the lead name on the booking (e.g. a letter sent by post, or email).
32. After 7 days the amount of cancellation fee is calculated and this takes effect from the date on which we receive your notice to exercise your right to cancel.
33. To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired.

Cancellation by Us

34. We reserve the right to cancel your booking for circumstances beyond our control: In case of Unfavorable weather or health and safety. If we and our supplier(s) consider you may cause harm to our reputation, or to property belonging to our suppliers. If the suppliers are unable to host the event for any reason, if changes you wish to make to the booking mean it is uneconomical or not practical to hold the event. If the whole of the event is cancelled, you can either have a refund of all monies paid or accept an alternative event of comparable standard from us. If we offer one (we will refund any price difference if the alternative is of a lower value).We shall be no further liability to you for cancellation of event.
35. It is not a failure to conform if the failure has its origin in your materials.
36. In relation to the Services, anything we say or write to you, or anything someone else says or writes to you on our behalf, about us or about the Services, is a term of the Contract (which we must comply with) if you take it into account when deciding to enter this Contract, or when making any decision about the Services after entering into this Contract. Anything you take into account is subject to anything that qualified it and was said or written to you by us or on behalf of us on the same occasion, and any change to it that has been expressly agreed between us (before entering this Contract or later).

Duration, termination and suspension

37. The contract continues as long as it takes us to perform the Services.
38. Either you or we may terminate the agreement or suspend the Services at any time by a written notice of termination or suspension to the other if that other: Commits a serious breach, or series of breaches resulting in a serious breach, of the Contract and the breach either cannot be fixed or is not fixed within 30 days of the written notice.

Privacy

39. Your privacy is critical to us. We respect your privacy and comply with the General Data Protection Regulation with regard to your personal information.
40. These Terms and Conditions should be read alongside, and are in addition to our policies, including our privacy policy (movivtravel.co.uk).

Governing law, jurisdiction and complaints

42. This agreement (including any non-contractual matters) is governed by the law of England and Wales.
43. Disputes can be submitted to the jurisdiction of the courts of England and Wales or, where the Customer lives in Scotland or Northern Ireland, in the courts of respectively Scotland or Northern Ireland.
44. We try to avoid any dispute, so we deal with complaints as follows: Must contact the appropriate person(s) as soon as possible, if you are unable to resolve the problem, then you must write to us within 7
days.

Changes to Terms and Condition

45. We can make changes to these Terms and Conditions which are necessary to comply with any applicable law or safety requirement. We will notify you of these changes.
